1. Introduction

These Terms and Conditions (“Agreement”) govern your use of the website www.fnforkliftrx.com ("Site") and the services provided by F&N Forklift Rx ("we", "our", "us") as a forklift mobile mechanic service. By accessing, browsing, or using our Site and booking our services, you agree to comply with these terms. If you do not agree to these terms, please refrain from using our Site or services.

2. Services Provided

We provide mobile forklift repair, maintenance, inspection, and parts replacement services throughout the valley of Arizona. Our services include, but are not limited to:

• Forklift diagnostics and troubleshooting
• Mechanical, electrical, and hydraulic repairs
• Preventative maintenance
• Emergency breakdown assistance
• Parts installation and replacement

These services are subject to availability and are provided in accordance with applicable laws.

3. Booking and Scheduling

• Booking Services: You can book our services via the Site or by contacting us directly at 602.586.7611 or service@fnforkliftrx.com. Once an appointment is scheduled, we will send a confirmation with service details.
• Cancellations: Cancellations must be made at least 24 hours in advance of the scheduled appointment. Failure to cancel or reschedule at least 24 hours before the service may incur a call-out fee of $95 to cover technician time and travel costs.
• Service Times: We strive to arrive at your location within the time window provided, but cannot guarantee exact arrival times due to variables such as traffic or unforeseen delays.

4. Payment Terms

• Payment: Payment for services is due upon completion, unless otherwise specified. We accept credit/debit cards, checks, electronic transfers.
• Estimates and Quotes: All service estimates are provided prior to work being done. If additional work is required, we will inform you before proceeding, and you will be provided with a revised estimate. 
• Late Payment: Invoices that remain unpaid after due date may incur a late fee of $25 per month until paid in full.

5. Service Warranty

• Labor Warranty: We provide a warranty on labor for 7 days, depending on the service rendered. If any issues arise with the work performed during the warranty period, we will revisit the site to address the issue at no additional cost, provided the problem is related to our initial work. 
• Parts Warranty: Parts installed by our technicians are covered by the manufacturer’s warranty, if applicable. Warranty periods vary by part and manufacturer. We will assist you in handling any warranty claims.

6. Customer Responsibility

• Access: You must provide our technicians with access to your forklift and any necessary areas where repairs or maintenance are to be performed.
• Accurate Information: You must provide accurate information about the nature of the problem and any previous repairs or maintenance work performed.
• Safety: It is your responsibility to ensure a safe work environment for our technicians. If, upon arrival, the worksite is deemed unsafe, we reserve the right to cancel or delay service, and you may incur a cancellation fee.

7. Limitation of Liability 

• No Liability for Indirect Damages: Our liability for any claim related to the services we provide is limited to the amount you paid for the service in question. We are not liable for any indirect, incidental, or consequential damages, including but not limited to loss of profits, business interruptions, or damage to property.
• Exclusions: We are not responsible for any defects or damages resulting from misuse, neglect, unauthorized modifications, or failure to maintain the equipment after our service.
• Force Majeure: We are not liable for delays or failure to perform services due to events beyond our control, including but not limited to natural disasters, accidents, or acts of government. 

8. Privacy & Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

9. Intellectual Property

All content on the Site, including but not limited to text, images, logos, graphics, and trademarks, is the property of F&N Forklift Rx and is protected by intellectual property laws. You may not use any content from the Site without our express written consent.

10. Termination

We reserve the right to terminate or suspend your access to the Site and services at our sole discretion, without notice, if you violate any of these terms or if we believe it is necessary for security, maintenance, or legal reasons.

11. Modifications

We reserve the right to modify or update these Terms and Conditions at any time. Any changes will be posted on this page with an updated date. By continuing to use our services after the changes are posted, you agree to the updated terms.

12. Governing Law and Dispute Resolutions

These Terms and Conditions are governed by the laws of the State of Arizona. Any disputes arising out of or related to these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The venue for any legal proceedings shall be in Phoenix, Arizona.
